Terms of Service

These Terms of Service (“Terms”) govern your use of ibuildclaytables.com (the “Site”) and the productized Clay table building services (the “Services”) provided by I Build Clay Tables, a DBA of Gamma Growth Partners LLC (“IBCT,” “we,” “us,” or “our”). By accessing the Site or purchasing the Services, you agree to be bound by these Terms.

1. The Services

IBCT provides productized Clay table building services in three tiers:

1.1 Table

A single Clay table built to your specifications, priced at $995 per Table, delivered within 72 hours of scope confirmation. Includes one ICP, one enrichment stack, and one output destination. Delivered live inside your Clay workspace, with a Loom walkthrough at completion.

1.2 Workbook

A connected system of 5 or more Clay tables, priced at $3,495 per Workbook, delivered within 14 days of scope confirmation. Includes a discovery call to scope the system, a hand-off call at delivery, and a 30-day support window for questions and minor adjustments. Delivered live inside your Clay workspace.

1.3 Subscription

Ongoing dedicated capacity priced at $4,995 per month with a 3-month minimum term, paid in full at the start of each term. Includes one active Table or quarterly Workbook, weekly progress calls, an onboarding discovery call, and access to a private Slack channel with an assigned operator. The first 3-month term is non-refundable once Services have commenced.

2. Prerequisite: Clay workspace

All Services require you to maintain an active subscription to Clay (clay.com) sufficient to support the Services purchased, including any required seats and credits. You are responsible for all Clay platform costs, including seat fees and credit consumption associated with Table and Workbook delivery. We will provide reasonable estimates of credit consumption when requested, but actual usage may vary.

You agree to add an IBCT operator as a collaborator to your Clay workspace at the level of access required to deliver the Services. You may revoke this access at any time directly within Clay. Revocation during an active build may delay or prevent delivery.

3. Scope of Services

3.1 What is included

The scope of each Service tier is described in Section 1 and on the Site. Tables and Workbooks are delivered as Clay tables within your Clay workspace, with a Loom walkthrough at delivery.

3.2 What is not included

Unless explicitly purchased as part of a Workbook or Subscription, the Services do not include: email sending, email infrastructure setup, domain warmup, copywriting beyond Claygent-generated drafts, paid advertising, CRM migrations, integrations beyond those available natively within Clay, or general GTM strategy consulting.

3.3 Specification and revisions

Each Service begins with a written specification (“Spec”), typically submitted through our intake form. The Spec defines the scope of work. Revisions within the original Spec are included as follows:

  • First Table revisions: for your first Table purchased, we iterate on the build until it correctly fulfills the original Spec. Material changes in scope, ICP, signals, or outputs are a new Spec and may require a new Table purchase.

  • Subsequent Tables and Workbooks: each includes a 7-day revision window from delivery. Revisions within scope are included; out-of-scope revisions may require additional purchase.

  • Subscription: revisions are managed through the assigned operator on an ongoing basis within the active scope.

We reserve the right to determine in our reasonable judgment whether a revision is within scope or constitutes a new Spec. Disagreements about scope will be discussed in good faith before any additional charges are incurred.

3.4 Delivery timelines

For Tables (72-hour delivery), the clock begins upon receipt of payment, submission and confirmation of the Spec, and granting of Clay workspace access. For Workbooks (14-day delivery), it begins upon completion of the discovery call, confirmation of the Spec, and granting of workspace access. Delays caused by missing Specs, missing access, or unanswered scope questions extend the timeline. Median delivery times are based on past performance and are not guarantees.

3.5 Missed discovery calls

If you book a discovery call and fail to attend without at least 24 hours’ notice, it is a no-show. No-shows do not trigger the non-refundable threshold in Section 4.3, but they interrupt delivery. You may reschedule a missed discovery call at no additional charge. Repeated no-shows (three or more without notice) may result in cancellation of the Services and forfeiture of the purchase.

4. Pricing and payment

4.1 Pricing

Prices are stated on the Site in U.S. dollars and are subject to change. Changes will not affect Services already purchased or active Subscription terms.

4.2 Payment terms

Table and Workbook purchases are charged in full at the time of purchase. Subscription purchases are charged in full at the start of each 3-month term.

4.3 Refunds

  • Table: refundable in full within 24 hours of purchase if work has not commenced. After work commences it is non-refundable, but our first-Table revision commitment applies (Section 3.3).

  • Workbook: refundable in full if you cancel before the discovery call. Once the discovery call takes place it is non-refundable.

  • Subscription: non-refundable once the term has commenced. You may decline to renew at the end of any 3-month term with at least 14 days’ written notice before the term ends.

4.4 Late payment and chargebacks

Failure to pay any amount when due may result in suspension of Services. Chargebacks initiated without first contacting us to resolve a dispute may result in immediate termination of Services and a permanent ban from future purchases.

5. Your responsibilities

By using the Services, you represent and agree that:

  • You have the authority to enter into this agreement on behalf of any organization you represent.

  • You will provide accurate and complete information in your Spec and communications, and maintain an active Clay subscription sufficient to support the Services.

  • You will use the Services only for lawful business purposes and not to violate any law, including anti-spam laws (CAN-SPAM, CASL, GDPR), or to engage in harassment, defamation, or fraud.

  • You are solely responsible for any outreach or use of contact data sourced through the Tables we build, including compliance with applicable privacy and anti-spam laws.

  • You will not share your IBCT account or Services access with unauthorized parties.

6. Intellectual property

6.1 Your data and outputs

You own the data you provide to us and the Clay tables built within your Clay workspace. We claim no ownership over outputs delivered to your workspace.

6.2 Our methods and templates

We retain ownership of our methods, workflows, internal templates, and Claygent prompts used to deliver the Services, and may use similar approaches for other clients. We will not share your specific Spec, ICP definitions, or proprietary information with other clients.

6.3 Anonymized case studies

We may reference completed Services in anonymized case studies, blog posts, or marketing materials, provided we do not disclose your company name, specific data, or proprietary details without your written consent. Notify us in writing if you prefer no anonymized reference be made.

7. Confidentiality

We treat all information you share with us in the course of receiving Services as confidential. We will not share your Spec, ICP definitions, contact data, or business information with any party other than as described in our Privacy Policy. This obligation continues after the Services end.

If you require a separate Mutual Non-Disclosure Agreement (NDA) before sharing sensitive information, contact us and we will accommodate reasonable requests.

8. Disclaimers and limitations

8.1 No warranties on output quality or business outcomes

The Services are provided “as is” and “as available.” We do not guarantee specific business outcomes, including meetings booked, deals closed, revenue generated, response rates, or list quality beyond the parameters of the Spec. Outcomes depend on many factors outside our control.

8.2 Third-party data and platforms

Our Services rely on Clay and its underlying data providers. We do not control and are not responsible for the accuracy or completeness of that data, changes to Clay’s pricing or features, the availability of Clay’s platform, or the deliverability of enriched contact information. You are solely responsible for verifying data accuracy before use.

8.3 Limitation of liability

To the maximum extent permitted by law, IBCT’s total liability arising out of or relating to these Terms or the Services is limited to the amount you paid us in the 12 months preceding the claim. In no event will IBCT be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost business opportunity, or loss of goodwill. Some jurisdictions do not allow such limitations, so the above may not apply to you.

8.4 Indemnification

You agree to indemnify, defend, and hold harmless IBCT, Gamma Growth Partners LLC, and our respective officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms or any law or third-party rights, and any outreach or action you take using the Tables or data we deliver.

9. Termination

You may stop using the Services at any time. We may suspend or terminate your access at our discretion if you violate these Terms, fail to pay amounts owed, or engage in abusive or unlawful conduct.

Upon termination, your access to the Services will end. We will retain records as described in our Privacy Policy. Sections that by their nature should survive termination — including limitations of liability, indemnification, intellectual property, and confidentiality — will survive.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or through the Site. Continued use of the Services after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, your sole remedy is to stop using the Services.

11. Governing law and disputes

11.1 Governing law

These Terms are governed by the laws of the State of Indiana, without regard to conflicts of law principles.

11.2 Disputes

We prefer to resolve disputes informally. If you have a concern, contact info@gammagrowthpartners.com before pursuing formal proceedings. If we cannot resolve a dispute within 30 days, either party may pursue available remedies.

11.3 Jurisdiction

Any legal action must be brought in the state or federal courts located in Marion County, Indiana, and you consent to the personal jurisdiction of these courts.

12. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any separately signed agreements, constitute the entire agreement and supersede prior agreements on the same subject.

  • Severability. If any provision is found unenforceable, the remaining provisions continue in full force and effect.

  • No waiver. Our failure to enforce any provision is not a waiver of that or any other provision.

  • Assignment. You may not assign your rights without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of the business.
